Welcome to DearMory, an all-in-one AI creation platform. By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, please do not use our services.

Service Usage

DearMory provides users with AI-powered creative tools including memorial video generation, photo processing, and more. You agree to use this service in compliance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

Credits System

1. Credits Purchase: You can purchase credits through the platform for AI creation services.
2. Credits Validity: Pay-as-you-go credits never expire. Subscription credits are valid during your active subscription period (monthly or yearly) and expire at the end of the billing cycle if unused.
3. Credits Consumption: Different AI features consume different amounts of credits, as displayed on the page.
4. Non-Transferable: Credits cannot be transferred to other users.

AI Generated Content

1. Content Ownership: You have full rights to use content generated using DearMory for personal or commercial purposes.

2. Photo Upload Authorization: You represent and warrant that you have the legal right to upload and use any photo submitted to DearMory. You must only upload photos of yourself, or photos for which you have obtained explicit consent from the person depicted (or their legal guardian/estate). Uploading photos of others without proper authorization is strictly prohibited.

3. Content Responsibility: You are fully responsible for the content generated using AI, including ensuring it does not infringe on others' rights. You shall not use AI-generated content for any unlawful purpose, including but not limited to fraud, impersonation, defamation, harassment, or creating misleading content that could deceive others.

4. Prohibited Content: You may not use this service to generate:

   • Content that violates laws and regulations
   • Content that infringes on others' intellectual property or personality rights
   • Pornographic, violent, or hate speech content
   • Fraudulent, deceptive, or misleading content (including deepfakes intended to deceive)
   • Content that violates others' privacy
   • Content that impersonates or misrepresents any person
   • Content used to fabricate consent, endorsement, or statements by any person

5. Content Moderation: We reserve the right to review and remove content that violates our policies, and to suspend or terminate accounts that repeatedly violate these terms.

Prohibited Activities

When using DearMory, you agree not to engage in any of the following prohibited activities:

• Attempting to bypass the credits system or abuse the service
• Interfering with or disrupting the security or performance of the service
• Using the service for any illegal or unauthorized purpose
• Automated bulk requests (unless authorized)
• Attempting to reverse engineer or hack the service

Privacy and Data Collection

Pricing and Payment

Service Availability

• We strive to maintain stable service operation but do not guarantee 100% availability
• We may suspend service for maintenance, upgrades, or other reasons
• Third-party AI service availability is beyond our control

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, if we believe your conduct violates these terms or is harmful to other users of the service, us, or third parties.

Acceptable Use Policy

Your use of DearMory is also subject to our Acceptable Use Policy, which prohibits the generation of sexually explicit, violent, hateful, or otherwise harmful content. Violations may result in account suspension or termination.

AI Service Disclaimer

DearMory is an independent AI creation platform. We access third-party AI models via API to provide image, video, and music generation services.

This platform is not an official product of any AI model provider, nor is it endorsed or sponsored by them. We operate independently and have no affiliation or partnership with the companies that develop the underlying models.

Disclaimer

The service is provided on an "as is" and "as available" basis. We make no warranties regarding:

• The accuracy, quality, or suitability of AI-generated content
• Uninterrupted or error-free operation of the service
• Specific effects or results from AI models
• The appropriateness of AI-generated content for any particular purpose

AI-generated content may not accurately represent reality. Memorial videos and photo effects are artistic interpretations created by AI algorithms and should not be considered factual representations. DearMory is not responsible for any consequences arising from the use, distribution, or publication of AI-generated content by users.

Users acknowledge that AI technology has inherent limitations and that generated results may contain inaccuracies, artifacts, or unintended modifications. DearMory does not guarantee that AI-generated content will meet your expectations or requirements.

Limitation of Liability
